Preamble

The Acherin Affair has brought to all of our attention a number of ambiguities in the law, as regards the constitutional rights of New Republic worlds, and the extent of those rights specifically as regards the use of one world's defense forces upon another world. These ambiguities have been the cause of considerable dispute in recent weeks, though where the Senate can agree, surely, is that it is in the interest of all parties (and the New Republic) to resolve the matter ad finitum. Therefore, where previous oversight measures have failed, this measure seeks both to affirm the present, enumerated rights of New Republic member worlds regarding the use of their fleets, and to make into law reasonable, new limitations where those rights are ambiguous.

Planet's Rights, Affirmed

This measure respects the sovereignty and the autonomy of the New Republic's member worlds, and their rights to self-defense and self-determination. However, insofar as one world (or worlds) may abuse these rights to the detriment of another planet's self-defense and self-determination, the measure recognizes that some reasonable limitation of a planet's fleet is necessary, under such circumstances.

However, the New Republic also recognizes that member planets, as sovereign and autonomous, do have certain rights and prerogatives reserved to them in the Common Charter, with respect to the use of their fleets; that among these are the defense of the planet, the defense of the planet's properties outside the New Republic, the enforcement of trade policies, sanctions and piracy laws, certain acts of protest (i.e. the blockade of another New Republic world), the assistance of other Republic worlds in disasters or famines, and combat operations against other Republic worlds if a reciprocal state of war exists between them.

These rights and prerogatives are inalienable, and may not be "revoked." Furthermore, a member world cannot have New Republic troops or bases stationed upon it without its consent, punitively or otherwise. New Republic member worlds are also sovereign over their own soldiers and vessels unless incorporated (temporarily, only in a state of emergency) into the New Republic Defense Forces at the request of the Chief of State. The Senate does not have the authority to nationalize a planet's defense forces without its consent.

Planet's Rights, Clarified

Member worlds do not have the right to, and are specifically prohibited from, conducting their defense forces in such a manner as to contravene New Republic foreign policy and interstellar trade policy, as determined by the Chief of State and the Senate. Member worlds have the right to determine their own policies with respect to other member worlds; a planet's policies toward worlds or factions outside of the Republic is presently ambiguous in the Common Charter and is the subject of this measure.

New Republic member worlds do have the right to determine economic policies (such as boycotts and tariffs) upon worlds or factions outside of the Republic, as well as the right to make political demands of such factions. However, this measure requires member worlds to obtain the consent of the New Republic Diplomatic Corps for the use of that world's defense forces upon another world or faction, outside of the New Republic (Provided; that the planet in question―the "target planet"―is, in fact, recognized in some form by the New Republic Diplomatic Corps. See "Definitions," below). The Diplomatic Corps should refuse such permission only when there is a compelling reason to do so, in the interest of the New Republic's foreign, defense, or economic policies.

A member planet that proceeds with an operation such as described above, without the consent of the New Republic Diplomatic Corps, may have those officials responsible for the operation, and its participants, fined up to 10,000 credits each, or imprisoned for no more than 3 standard years, or both, as determined by the courts.

Definitions

A "planetary defense force" or "planetary defense fleet" is defined as any and all of the ships, soldiers, tanks, etc. in a member world's possession, or in its employ, for uses or purposes other than domestic law enforcement. The term "member world" (or "planet") or "New Republic world" (or "planet") is self explanatory, but for the purpose of this legislation includes also all private organizations affiliated with the New Republic, or operating under its auspices or the auspices of a member planet.

The "recognition" of a planet by the New Republic Diplomatic Corps is defined, in this measure, as any status or designation conferred on a planet outside of the New Republic, by the Diplomatic Corps (these may include "allied," "neutral," "unaligned," "legitimate" [or "illegitimate," or "criminal"] or "hostile" [or "Imperial"] worlds, among others). However, if a New Republic member world intends the use of its defense forces upon a world or faction with no such recognition, the Diplomatic Corps must, nonetheless, be consulted for intent to confer such recognition.
