The Biological Weapons Act

Purpose

The purpose of this act is to prevent biological warfare and attacks against the Empire and its affiliate planets.

Intent

This act does not prevent the peaceful scientific research and development.

Prohibitions With Respect to Biological Weapons

Whoever knowingly develops, produces, stockpiles, transfers, acquires, retains, or possesses any biological agent or toxin for use as a weapon, or knowingly assists a foreign state or any organization to do so, shall be fined no less than one billion credits or imprisoned for life or both.

The term 'for use as a weapon' does not include the development, production, transfer, acquisition, retention, or possession of any biological agent or toxin for prophylactic, protective, or other peaceful purposes.

Seizure, Forfeiture and Destruction

The Chairman of the Defense Committee may request the issuance, in the same manner as provided for a search warrant, of a warrant authorizing the seizure of any biological agent or toxin that:


  • 1) Exists by reason of conduct as prohibited above.
  • 2) Is of a type or quantity that under the circumstances has no apparent justification for prophylactic, protective, or other peaceful purposes.

Definition
The term 'biological agent' means any micro-organism, virus, or infectious substance, capable of causing:


  • 1) Death, disease, or other biological malfunction in a human, an alien, an animal, a plant, or another living organism.
  • 2) Deterioration of food, water, equipment, supplies, or material of any kind.

The term 'toxin' means, whatever its origin or method of production:


  • 1) Any poisonous substance produced by a living organism.
  • 2) Any poisonous isomer or derivative of such a substance

I vote enthusiastically in favor of this measure. I applaud you for proposing it, Senator Ryuun. During the Clone Wars, Naboo came perilously close—within moments—of a complete and total gaiacide, the destruction of all life on the planet, as a result of a biological weapon. Prohibitions on biological weapons, in my opinion, can never be stringent enough. I'm certain that the people of Naboo agree, and stand, as I do, in support of this measure. I hope my colleagues will do so as well.

Garos IV votes in favor of this act. All of our planets could be affected by biological weapons and warfare for that matter. It is imparitive that we pass this measure immediately.

And what about the military and naval application of biological weapons? Should the need unforseeably arise, I do believe that the decision to authorise the use of biological weapons lays with the ranking officer or fleet commander. If this act hinders decision making on the battlefield, it could have negative effects. I am no expert in these matters, so please don't assume I'm advocating the use of bio-weapons on the whims of whomever controls them, but it is my belief that certain allowments be made for those in the correct position to be using them. We obviously don't need them for military purposes now, but in the future who knows what may befall us. I shudder to think what would happen in a situation where the quick use of bio-weapons is needed, but held up by a piece of legislation which, in all fairness, I personally think should not be left to the Senate to decide.

Kaal withholds from voting until this issue is addressed.

Senator Lohden, if any vessels are already carrying biological weapons on the of-chance they may be necessary, then that is going to far as it is. When we consider the weapons aboard the vessels the Empire had at hand; the capable pilots and their snubfighters and the troops who fight upon the ground, it seems as if the Imperial war machine had no need of terrifying biological deterrents.

However, in the event a biological weapon had to be utilized, I believe it would take being voted on by the Defense Council and run through the Chief of State before any vessel could be loaded with biological weapons.

It seems the Senate is unanimous—quite literally, as far as the Senators of Dantooine, Telos, Vjun, Brentaal, and Anaxes are concerned—in support of this measure. Senator Lohden, your concern is appreciated, but be assured it is the belief of the Ruling Council that the wording of the measure is such as to render that concern unnecessary. You will understand, I hope, if I say no more on this subject. However, I am, of course, willing to discuss it with you in private. With that said, Senators, the measure passes without objection.
